TERMS AND CONDITIONS
RESPONSIBLE PARTY: The individual that reserves the property is considered the responsible party for the renting of the property; now known as the vacationer. The Vacationer agrees that he/she is 25 years or older and fully agrees to the Terms and Conditions of this Rental Contract as follows:
ESCROW: Pawleys Island Realty Company, LLC will place the reservation payment in an interest-bearing escrow account and shall receive any and all interest earned.
TAX INCREASE: Any and all governmental surcharges and taxes imposed prior to occupancy shall be added to the total balance due and shall be paid by the vacationer.
METHOD OF PAYMENT: Cash, Personal Checks, ACH, MasterCard, VISA, AMEX, and Discover are the acceptable forms of payment. Two-party checks will not be accepted. The balance on all rentals is due 30 days prior to arrival; however, if a reservation is made within 30 days of the arrival date, no personal checks or ACH will be accepted and payment in full is due at time of booking. Vacationer agrees that if their check is not received by the due date, they will pay the payment by credit or debit card on the due date and Pawleys Island Realty Company, LLC will shred the check when received. Pawleys Island Realty Company, LLC, imposes a 3% surcharge on the amount charged on credit card transactions, which is not greater than our cost of acceptance. There is no surcharge on Debit Cards or ACH.
DEPOSITS/PAYMENTS: Vacationers agree to pay all payments based on the terms and conditions of the property and Pawleys Island Realty Company, LLC. If reserving a property 30 days or less from the date of arrival; payment in full is required at time of reservation.
COMPANY CANCELLATION POLICY: To avoid cancellation of your reservation, please refer to the specific due dates on this rental contract. Your final balance is due no later than 30 days prior to your arrival date. Reservations that have open balances under 30 days to arrival may be cancelled and any funds currently received on the reservation will be forfeited. If the reservation is cancelled due to lack of payment, the property will be available to book by another vacationer.
NON-REFUNDABLE FEES: Once a reservation is booked and payment is received, in the case that the vacationer needs to cancel the reservation, the following fees are non-refundable for any reason: Guest Service Fee, Cancellation Fee, Trip Insurance Premium, and any associated taxes.
VACATIONER CANCELLATION POLICY: Advanced reservation deposits are non-refundable. Advanced Deposits are only transferrable within the same property and cannot be transferred to any other property. If your reservation is cancelled for non-sufficient payment or if you need to cancel your reservation after you have paid your initial deposit, please call our office at 843-237-2000 or email us at [email protected]. Pawleys Island Realty Company, LLC will attempt to re-rent the property. If your property is re-rented, your deposit will be returned to the booking vacationer minus the non-refundable fees. (The guest service fee, cancellation fee, trip insurance premium, and all associated taxes are non-refundable). If the property does not re-rent 30 days prior to your arrival date, you can reinstate your reservation at which time your final payment is due. Any reservation not paid in full 30 days prior to arrival will be closed and any funds on deposit will be forfeited. If you cancel your reservation less than 30 days prior to arrival, after you have paid in full, and the property has not re-rented, you may reinstate the reservation anytime up until 7 days prior to your arrival date. If your property is re-rented, your deposit will be returned to the booking vacationer minus the non-refundable fees. (The guest service fee, cancellation fee, trip insurance premium, and all associated taxes are non-refundable).
RESERVATIONS NON-TRANSFERABLE: Properties reserved sight unseen are represented by Pawleys Island Realty Company, LLC as realistically as possible with regard to space, amenities, and physical condition. Funds received on a reservation are non-transferable between vacation properties. Once a property has been reserved, the reservation cannot be moved to another property without re-renting the original property.
UNAVAILABILITY: If for any reason, the property reserved is no longer available, Pawleys Island Realty Company, LLC reserves the right to move the reservation to a comparable property or provide a refund of the funds on deposit less that Trip Insurance Premium if applicable. If a comparable property is not available and the vacationer would like to upgrade, the vacationer will be responsible for the difference in cost and fees. Vacationer will be notified via email or by phone if an email is not provided, if the property becomes unavailable.
SUBLETTING: This agreement shall not be assigned nor the premise sublet without the prior written consent of the Pawleys Island Realty Company, LLC and the owner. Transferring weeks in the same property must be requested 30 days prior to arrival and requires approval from Pawleys Island Realty Company, LLC and the owner.
OCCUPANCY: Vacationer agrees not to exceed the posted occupancy of the property at any time and the person making the reservation is required to occupy the property. The vacationer that reserved the property is fully and completely responsible for any violation to the occupancy policy and for any damages to the property due to overcrowding. The property is for family vacations only and any house parties, weddings, or overcrowding events are strictly prohibited in and/or on the property and premises. ANY violation will result in immediate termination of the rental reservation, vacationers will be required to vacate, and no refunds will be given. Any damages to the property will be charged to the vacationers reservation on the credit card on file.
DAMAGE WAIVER FEE: All reservations will be charged a non-refundable Damage Waiver Fee unless a Security Deposit has been charged. The Damage Waiver Fee covers any REPORTED accidental damage up to $1000.00. This does not negate the vacationers and their guests responsibilities as a vacationer. It is the vacationers responsibility to notify Pawleys Island Realty Company, LLC of any damages and the vacationer agrees that any cost above the $1000 coverage will be the vacationers responsibility and charged to the credit card on file.
SECURITY DEPOSIT (if applicable): If a Security Deposit is charged on your reservation, the funds will be used to cover any and all financial losses caused by the vacationer or any party of the vacationer in regards to damages to the property, breach of the rental contract, including any unpaid rent or other outstanding unpaid charges. Any amount over the Security Deposit will be the vacationers responsibility. The Security Deposit will be returned within 30 days from your departure date less any applicable charges for damages, unpaid rent or other unpaid charges agreed upon on the rental contract.
DAMAGES: All properties are inspected prior to check-in and again at departure. The vacationer agrees to maintain the property in good condition. Any damage, breakage, or loss of property which is caused by the vacationer or anyone in the vacationers party, which is not reported and covered under the Damage Waiver provision, will be charged to the vacationer. This includes but is not limited to: torn, stained, broken or damaged furniture, blinds, property structure, bedding, rug/carpet/flooring, etc. Please remember that the property you are renting is someone's home and we ask that the property be respected and treated in a manner that does not cause damage.
INCURRED CHARGES DURING YOUR STAY: Vacationer is responsible for any charges incurred during the stay that have been charged to the property, such as: rented movies, pay per view, sports channels, etc., will be charged to the vacationer at the time the bill is received by our office.
FIREARM POLICY: We understand that many people are licensed to carry firearms. Though we expect that gun owners are responsible to ensure that their firearm is secure and is not left abandoned at the rental property, for the safety of our employees and vacationers, we want you to be aware that Pawleys Island Realty Company, LLC has a strict policy on a firearm that is abandoned in a property. There is a $500 handling charge that will be charged to the vacationers reservation on the credit card on file. If a firearm is found at a Pawleys Island Realty Company, LLC property, the firearm will be secured at our office for no more than 24 hours from the time it is found, and any ammunition will be removed and will not be returned with the firearm for safety purposes. The vacationer on record will be notified and the gun owner will need to pick up the firearm from our office or provide us with a Federal Firearm License (FFL) Dealer to ship the firearm to. The cost of the handling fee and cost to ship the firearm will be at the expense of the vacationer. If the gun owner does not pick up the firearm or provide a Federal Firearm License (FFL) Dealer, the firearm will be turned over to the Georgetown Police Department. Pawleys Island Realty Company, LLC takes an abandoned firearm very seriously and will adhere to the Firearm Policy in any occurrence.
DOG POLICY: Dogs are not allowed in any properties or on the premises unless noted in the accommodations. Dog Friendly homes are available and the only properties where dogs are allowed. Vacationer agrees to adhere to the dog policies set forth by the owner and Pawleys Island Realty Company, LLC. Vacationer accepts responsibility and agrees to replace or pay for any loss, breakage or damage caused by their dog(s) as well as additional cleaning if required. Vacationers are responsible to clean up after their dog(s) in the property, on the premises, and on the beach areas. It is recommended that the vacationer sweep or vacuum periodically during their stay to keep up on the dog hair. Pawleys Island Realty Company, LLC advises that dogs be secured or in crates when maintenance needs to enter the property. Please Note: The non-refundable dog fee is charged by the owner for allowing a dog at the property and does not cover any damages or additional cleaning charges. Any violation with any animal in a "Not Dog Friendly" home will result in immediate termination of the rental contract, vacationer and their guest will vacate the property, and a fee of $250 will be charged to the vacationers reservation to the credit card on file, to cover additional cleaning and/or extermination treatment.
SERVICE ANIMAL: Pawleys Island Realty Company, LLC complies with Federal ADA standards regarding Service Animals. To encourage transparent communication and a smooth rental experience, we ask vacationers to inform us in advance of arrival when a member of their party requires the use of a service animal. Emotional Support and/or Therapy animals are not considered service animals under the ADA and will not be permitted in any "Not Pet Friendly" rental property. Pawleys Island Realty Company, LLC has the right to request the removal of a service animal from the rental property, if the animal is determined to be out of control and the animal's handler does not take effective action to control the animal, the animal is left unattended in the rental unit, or the animal is deemed not housebroken.
ANIMAL POLICY OTHER THAN DOGS OR SERVICE ANIMALS: Other than what has been defined under the Dog Policy and Service Animal Policy sections, Pawleys Island Realty Company, LLC and the owners prohibit any other types of animals in any of the properties at any time. This includes, but not limited to: cats, ferrets, hamsters, reptiles, etc. Any violation will result in immediate termination of the rental contract, vacationers will be required to vacate, and no refunds will be given. Any damages or additional cleaning costs will be the vacationers responsibility and will be charged to the credit card on file.
GRILLING: Absolutely NO grills are allowed to be operated on porches, decks, balconies, or under the houses. Grills may only be used in areas that are at a safe distance from the house. IMPORTANT NOTICE: Due to fire hazard, no charcoal is to be used in a propane grill.
CHECK-IN / CHECK-OUT: Vacationer agrees to adhere to the check-in and check-out times. Check-in time begins at 4:00PM and check-out time is no later than 10:00AM, no exceptions.
PACKAGE DELIVERY: Any packages being shipped to our office by the vacationer or anyone in the vacationers party, must have the name of the vacationer on the label and mailed to: Pawleys Island Realty Company, LLC, 88 North Causeway, Pawleys Island, SC 29585. All packages will be left on our office front porch. Pawleys Island Realty Company, LLC assumes no liability for lost or stolen packages. Please do not have packages delivered more than two days prior to arrival.
LOST OR LEFT BEHIND BELONGINGS: Pawleys Island Realty Company, LLC is not responsible for any items lost or left on or around the property during vacationers stay or after check-out. It is the vacationers responsibility to contact our office if they feel that items may have been lost or left behind. If items are found, Pawleys Island Realty Company, LLC will send the items to the vacationer at the vacationers expense. Vacationer will need to provide our office with a name, address and Credit Card information to secure payment prior to shipping. There will be an additional handling fee plus the cost of shipping charged to the vacationer.
LOST KEYS: The vacationer is responsible for all sets of keys provided at time of check-in. If the vacationer or anyone in the vacationers party loses a key, the vacationer will assume the cost for re-keying the home. The price for re-keying the home is $150.00 and is payable by cash or credit card only at time of check out.
OWNER CLOSET(S): Any locked closets in the rental property are reserved for the storage of the owners private property and not for vacationers use. These closets are not included in the rental. If any vacationer or guest is found to have broken into or attempted to break into a locked closet, the cost of replacement or repair will be the vacationers responsibility and charged to the vacationer reservation to the credit card on file. The vacationer may not be allowed back to the property.
AUTHORIZED ENTRY: Vacationer is being made aware that it may be necessary for a representative of Pawleys Island Realty Company, LLC or an authorized repair person to enter the vacation property for purposes in connection with repairs, care or management of the property. If this is a Dog Friendly property, Pawleys Island Realty Company, LLC advises that the dog(s) be secured or in crates when entering the property.
LIABILITY: The vacationers and their guests agree to hold Pawleys Island Realty Company, LLC and the homeowner harmless and without liability for any damage or theft of the vacationer or vacationer guest personal property or for any injury or death of any vacationer or vacationer guest occurring on or about the premises. The vacationer and vacationers guests understand that this also includes, but not limited to pools, spas, elevators, vehicles, recreational vehicles, kayaks, bikes, etc.
CONSTRUCTION / RESTORATION DURING YOUR STAY: Pawleys Island Realty Company, LLC and the owner of the rental property that the vacationer has reserved, is not responsible for any construction and/or restoration issues during the vacationers stay that include, but not limited to: altered views, noise, music, street parking, and/or disruption of the beach access. Contractor hours of operation are between the hours of 7:00am to 6:00pm, seven days a week, other than in cases of urgent necessity in the interest of public safety, and then only with a permit from the Chief of Police. NO refunds shall be issued due to construction and/or restoration issues.
APPLIANCES/CABLE/INTERNET (including ELEVATORS): The working order of all appliances including but not limited to: TVs, Internet and internet equipment, radios, ceiling fans, refrigerators, stoves, washers, dryers and air conditioning units, are not guaranteed. Refunds, reductions and/or rebates will not be given for failure or breakdown of any appliance or other issue including but not limited to: Internet and/or Cable issues during your stay. Contact our office promptly to report any inoperable equipment. All repairs will be made in a timely manner. NOTE: Service requests called in after 5:00pm may not be handled until the following business day. Elevators: if there is an issue with the property elevator, every effort is made to repair it in a timely manner. Should it be determined that the vacationer or anyone in the vacationers party has misused or not followed the elevator instructions, the vacationer may be charged for a service call and without elevator service during your stay.
PEST CONTROL: Pawleys Island Realty Company, LLC and owners provide regular and precautionary treatment for pest control on all properties. As we are in a sub-tropical climate, we are unable to guarantee that your stay will be pest free; however, we will make every effort to promptly address any pest control issues during your stay. As these types of situations are out of our control, we do not offer partial or any form of refund or compensation for pest issues.
INCLEMENT WEATHER POLICY: For the safety of our vacationers, Pawleys Island Realty Company, LLC reserves the right to begin securing and boarding up any and all properties if there is a mandatory evacuation implemented. There may also be times during Tropical Storms and extreme weather conditions that the owner or Pawleys Island Realty Company, LLC determines that the property needs to be secured and boarded up to prevent damage. This also includes pulling or turning over all outside furniture, lightweight grills, etc. If and when these dangerous occasions arise, vacationers agree to leave the premises/island, if required, and turn in all house keys to Pawleys Island Realty Company, LLC. or enter the keyless entry departure code. If the vacationer refuses to leave the property or does not allow Pawleys Island Realty Company, LLC to secure the property or outside items, the vacationer agrees to hold harmless Pawleys Island Realty Company, LLC and the property owners for any liability, injury or any situations that arises during their stay. Vacationers that refuse to leave, may be deemed financially responsible for any damages, loss of outdoor items, and/or personal property damages (such as vehicles, beach equipment, etc.). If a mandatory evacuation is implemented and the vacationer purchased Trip Insurance on the reservation, please see Trip Insurance Policy section of this contract for further details and contact information. If the vacationer did not purchase Trip Insurance, NO REFUNDS will be issued by owner or Pawleys Island Realty Company, LLC.
NO SMOKING OR VAPING POLICY: All homes rented by Pawleys Island Realty Company, LLC prohibit smoking or vaping in the property or on the premises. Should it be determined that during your stay the No Smoking No Vaping Policy has been violated, a charge of up to $500 will be charged to the vacationers account on file.
TRIP INSURANCE POLICY: HIGHLY RECOMMENDED - We are pleased to offer RedSky Travel Insurance. We are looking out for you and your vacation investment. By electing to purchase this insurance, you may be reimbursed for your unused, non-refundable, pre-paid trip costs if you are forced to cancel for a covered reason. The trip insurance premium is due with your first rental payment or can be added up until 30 days prior to your arrival date. For more information about RedSky Travel Insurance, we recommend visiting www.trippreserver.com. PLEASE NOTE: NO REFUNDS will be issued by owners or by Pawleys Island Realty Company, LLC for any weather-related issues and/or other reasons that the vacationer is unable to utilize the property.
DEPARTURE EXPECTATIONS: Prior to departure the vacationer is responsible to put all trash in plastic bags and place the bags in the outside garbage receptacles, wash all dishes and put them away or load the dishwasher and start it before leaving. Also, if you rented linens, strip all beds of the linens and place all linens and towels in the provided bags and put on the road facing porch. Leave all mattress covers, comforters and pillow shams on the beds. If there is any soiled bedding, it is the vacationers responsibility to report it to Pawleys Island Realty Company, LLC prior to departure. Otherwise, vacationer will be charged to replace bedding. Please make sure that you are putting the rented linens and towels ONLY in the provided bags. Any missing blankets, pillow shams, or other bedding will be the responsibility of the vacationer to cover the cost to replace and will be charged to the credit card on file. IMPORTANT DEPARTURE NOTE: Prior to departure it is the vacationers responsibility to walk through the property to ensure that there is no damage or moved furniture. Any non-reported damages, moved furniture, and/or missing items noted during departure inspection will be the vacationers responsibility to cover all costs and will be charged to the credit card on file. Pawleys Island Realty Company, LLC and the owners have the right to refuse renting in the future to a vacationer if a property is left in an unacceptable condition.
MOVING INDOOR OR OUTDOOR FURNITURE: Moving furniture can cause damage to floors, doors, walls, and to the furniture itself. Vacationer agrees not to move or rearrange any furniture inside or outside the property. If vacationers move furniture, any damages to floors, walls, or other items will be replaced or repaired at the cost to the vacationer. If furniture is found to have been moved and Pawleys Island Realty Company, LLC must send an employee out to put the furniture back in its original location, the vacationer will be responsible for the cost to move the furniture back and the cost will be charged to the credit card on file.
RENTAL HOMES FOR SALE: In the event that the vacation property you are renting is on the market for sale, you will be informed of potential showings with next-day notification. These showings may occur any day between the hours of 9:00am and 5:00pm. We will try our best not to cause you any inconvenience.
ALTHOUGH EVERY PRECAUTION IS TAKEN TO ENSURE THE ACCURACY HEREIN, PAWLEYS ISLAND REALTY COMPANY, LLC IS NOT RESPONSIBLE FOR ANY ERRORS OR OMISSIONS IN THE CONTENT OF THIS RENTAL CONTRACT. IF ERRORS AND OMISSIONS OCCUR, THE VACATIONER AND PAWLEYS ISLAND REALTY COMPANY, LCC RESPRESENTATIVE WILL MEDIATE TO RESOLVE THE ISSUE.
I, THE VACATIONER, BY SELECTING THE "I HAVE READ AND AGREE TO THE RENTAL POLICIES" BOX ON THE WEBSITE PAYMENT PAGE UNDER RENTAL POLICIES SECTION, ACKNOWLEDGE THAT I HAVE READ, UNDERSTAND, AND ACCEPT ALL THE TERMS AND CONDITIONS ON ALL PAGES OF THIS RENTAL CONTRACT.
